Welcome to Messages: SMS Texting & MMS ("the App"). By downloading, installing, or using the App, you agree to be bound by these Terms of Use ("Terms"). If you do not agree, please uninstall and do not use the App.
1. App Functionality and Default Handler Status
The App is designed to act as your device’s default SMS and MMS handler. To function properly, it must be granted default SMS status by the Android operating system. By granting this status, you authorize the App to send and receive standard text and multimedia messages on your behalf via your mobile carrier.
2. Device Access and Permissions
To enable its core features and background processes, the App requires specific permissions. By using the App, you agree that it may access:
SMS & MMS Databases: To manage, display, send, and receive your messages.
Contacts: To display caller IDs and facilitate new conversations.
Microphone & Camera: Exclusively for recording audio notes and capturing media to send as MMS attachments when manually initiated by you.
System Alert Window (Display Over Other Apps): To display floating message interfaces or quick replies. Note: This feature is explicitly provided for convenience and will never be used to display third-party advertisements or disruptive content over your active screen or lock screen.
Background & Notification Services: To process messages, alert you to incoming texts, and manage scheduled messages.
3. Biometric Security and App Lock
The App provides an optional feature to lock specific chats or the entire application using a PIN, password, or your device's native biometric hardware (e.g., fingerprint).
You acknowledge that this security is handled locally by the Android OS.
We do not extract, store, or transmit your biometric data.
We are not responsible for any data loss, inability to access your messages, or device lockouts resulting from forgotten passwords or biometric failure.
4. Third-Party Services and Advertising
The App incorporates third-party software development kits (SDKs) and APIs to function efficiently and remain free to use:
Google Mobile Ads (AdMob): The App is ad-supported. By using the App, you consent to the display of advertisements. These ads are served by Google AdMob and may use your device's Advertising ID.
Firebase Services: The App uses Firebase Crashlytics, Analytics, and Cloud Messaging to ensure stability, track performance bugs, and deliver notifications.
Google Maps Services: Used to render map data for location-sharing features.
Your use of these third-party integrations is also governed by their respective Terms of Service and Privacy Policies (e.g., Google's Terms of Service).
5. User Conduct and Restrictions
You are solely responsible for the content of the messages you send using the App. You agree that you will not:
Use the App to send spam, unsolicited commercial messages, or malicious software.
Use the App to harass, threaten, or distribute illegal, abusive, or sexually explicit material.
Interfere with, manipulate, or attempt to reverse-engineer the App's source code, ad implementations, or background services.
6. Carrier Charges and Liability
The App utilizes your existing cellular connection to transmit SMS and MMS messages. You are solely responsible for any messaging rates, data charges, or fees incurred through your mobile carrier.
We do not guarantee the successful, secure, or timely delivery of any message, as delivery is entirely dependent on your cellular network provider.
The App is not a replacement for an emergency dialer and cannot be used to place voice calls to emergency services.
7. Limitation of Liability
To the maximum extent permitted by law, the developers of the App shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, loss of access to messages, or device malfunctions arising from your use of the App, the integrated third-party SDKs, or any failed message delivery.
8. Changes to the App and Terms
We reserve the right to modify, update, suspend, or discontinue the App or any feature (including advertising placements) at any time. We may also revise these Terms. Continued use of the App after modifications constitutes your acceptance of the new Terms.
9. Governing Law
These Terms shall be governed by and construed in accordance with applicable legal jurisdictions. Any disputes arising from your use of the App will be subject to the exclusive jurisdiction of the competent courts.
