Welcome to Messages: SMS Texting & MMS ("the App"). By downloading, installing, or using the App, you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, please do not use the App.
1. Description of Service
Messages: SMS Texting & MMS is a mobile application designed to act as your device’s default SMS and MMS handler. The App provides features for sending and receiving standard text messages, multimedia messages, voice notes, and location data via your mobile carrier network.
2. Permissions and Device Access
To function correctly, the App requires specific permissions. By using the App, you acknowledge and agree that the App will access the following device features:
SMS & MMS Data: To send, receive, and display messages as your default handler.
Contacts: To display caller/sender information and allow you to initiate new conversations.
Microphone: Exclusively to allow you to record and send voice notes within your chats.
Location: Exclusively to allow you to share your physical location within a chat when manually initiated.
Phone State and Network: To manage message delivery via the internet or your cellular provider.
Your use of these features is also governed by our Privacy Policy, which details how your data is handled.
3. User Obligations and Restrictions
By using the App, you agree that you will not:
Use the App for any illegal, harmful, or unauthorized purpose, including sending spam, malicious links, or harassing messages.
Reverse engineer, decompile, or attempt to extract the source code of the App.
Attempt to bypass or manipulate any security features or Android system protections.
Use the App to distribute illegal material or violate the intellectual property rights of others.
4. Third-Party Services and Libraries
The App integrates third-party software libraries and services to enable specific functionalities. These include:
Google Play Services: Used for location mapping and background service optimization.
Glide: Used for image and multimedia loading within the user interface.
Your use of features powered by third parties (such as location mapping) may be subject to those third parties' respective Terms of Service and Privacy Policies.
5. Carrier Fees and Charges
The App utilizes your device’s cellular connection and data plan to send and receive standard SMS and MMS messages. You are solely responsible for any carrier rates, data charges, or messaging fees incurred through your mobile network provider while using the App.
6. Disclaimer of Warranties
THE APP IS PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS. We make no warranties, express or implied, regarding the reliability, accuracy, or availability of the App.
Message Delivery: Because the App relies on third-party mobile carriers, we do not guarantee that any SMS, MMS, or location message will be delivered successfully, promptly, or accurately.
Emergency Services: The App is not a replacement for your standard telephone dialer for contacting emergency services (e.g., 911, 112).
7. Limitation of Liability
To the maximum extent permitted by applicable law, the developers and owners of Messages: SMS Texting & MMS shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill resulting from:
Your use or inability to use the App.
Any failed, delayed, or misdirected messages.
Any unauthorized access to your device or messages.
8. Intellectual Property
All rights, title, and interest in and to the App, including its design, text, graphics, and underlying code, are the exclusive property of the developers of Messages: SMS Texting & MMS. You are granted a limited, non-exclusive, non-transferable license to use the App for personal communication purposes.
9. Modifications to the App and Terms
We reserve the right to modify, update, or discontinue the App (or any part thereof) at any time without prior notice. We may also revise these Terms from time to time. Continued use of the App following any modifications indicates your acceptance of the updated Terms.
10. Governing Law
